API terms of use

API - Terms of use

The Trove Application Programing Interface (API) is a service offered by the National Library of Australia (the Library). It offers a programmatic way to extract records and full text from Trove and re-use this content for a variety of purposes, including further analysis of the content or to build new online services.

The Library values creativity and encourages broad use of the API and so it is made freely available for both non-commercial and commercial use. While we aim to make content as accessible as possible, we need to limit requests to the API to maintain the functionality of the API and the Trove service.

Your use of the Trove API constitutes your agreement to be bound by these Terms of Use as may be changed, amended or modified from time to time at the Library’s sole discretion and without notice. These Terms of Use are to be read in conjunction with other terms on this website including terms as to privacy and copyright.

Contact information. You agree to provide the Library with accurate and complete contact details and to inform us of any changes to that information.

Use of the API key. Use of the API requires the issuance of an API key. The API key is not transferable and you are responsible for its use. If you are applying for an API key on behalf of a company or other organisation, you represent that you have the authority to bind that company or organisation.

Information about use. You agree to provide the Library with a description of any applications that include Trove content via the API. The Library will require free temporary access to publicly available applications or websites to ensure that these Terms of Use have been complied with.

Non-commercial Use. The Library will automatically issue an API key on request for non-commercial purposes.

Commercial Use. The Library may issue an API key on request for commercial purposes.  Specific written approval by the Library is required before any commercial use.  The Library will not enter into exclusive agreements with any commercial providers and will provide the same level of service for all. Only one key will be issued for use by each service offered by a commercial entity. Individual keys will not be issued for customers of that commercial entity.

Attribution. You will acknowledge Trove as the source of your data and include a link to Trove. You are welcome to use the ‘Powered by Trove’ logo on your site. If you present the content of individual items you should link back to the item in Trove or display its persistent identifier.

Copyright. Some Trove content is in copyright and owner rights must be respected. It is your responsibility to ascertain copyright status and clear copyright with the original provider (not the Library) before making content publicly available.

Removal of content. You must remove or delete content you have obtained from the Library, in 30 days or less, if we request that you do so.

Termination of access. You acknowledge that we reserve the right to cancel your access to the API service without prior notice.

Service provision. Where possible, we will make new versions of the API backwards compatible, however we do not undertake to ensure backwards compatibility. You acknowledge that we reserve the right to turn off or modify the API service at any time without prior notice. You acknowledge that we do not make any undertakings with regard to service availability or performance. We reserve the right to limits calls on the API as required to maintain manageable demands on our servers.

Lawful use. Your use of Trove content must be lawful. You will not display content obtained via the API in contexts that are defamatory, pornographic, obscene, threatening, offensive, invasive of privacy, or which would constitute or encourage a criminal offence, or give rise to liability under, or breach, any law, or that are detrimental to the reputation of the Library in any way.

Limitation of Liability.  The Library is not liable for any loss, injury, claim, liability or damage of any kind resulting from your use of the Trove API. The Library is not liable for any special, indirect, incidental, or consequential damages of any kind whatsoever (including, without limitation, legal fees) in any way due to, resulting from, or arising in connection with the use of or inability to use the Trove API. To the extent that this limitation of liability is prohibited, the Library’s sole obligation to you for damages is limited to $100.00.

Indemnity. You indemnify the Library, its officers, directors, employees, agents, distributors and affiliates, and any third party information providers to Trove, from and against any or all third party claims, demands, liabilities, costs or expenses, including reasonable legal fees, resulting from any breach of these Terms and Conditions of Use by you. You must cooperate as fully as reasonably required in the defence of any such action.

Jurisdiction. These Terms of Use are governed by the laws of the Australian Capital Territory.
